General Terms

By accessing and using AnywhereScada, you agree to be bound by these Terms & Conditions. These terms apply to the entire platform, including the website, APIs, MQTT services, and any communication between you and Joy Automation, Inc.

Joy Automation, Inc. reserves the right to update pricing, policies, features, and service offerings at any time. Material changes will be communicated via email or platform notification.

Service Description

AnywhereScada is a cloud-based platform for industrial automation and SCADA data. The service provides:

  • MQTT broker connectivity for Sparkplug B and other protocols
  • Data storage, visualization, and analytics
  • API access for integration with third-party systems
  • User workspaces ("Spaces") for organizing industrial data

Account Terms

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Ensuring your use complies with applicable laws and regulations
  • Providing accurate and current account information

You must be at least 18 years old to create an account. Accounts registered by automated methods are not permitted.

Subscription & Billing

AnywhereScada uses usage-based billing:

  • Free Tier: Up to 500,000 metric values stored
  • Paid Tier: $10 per month for each additional 500,000 metric values stored over the free tier

You agree to:

  • Pay all charges associated with your account
  • Provide valid payment information via Stripe
  • Accept that service may be suspended if payment fails or usage limits are exceeded without an active subscription

Joy Automation, Inc. reserves the right to modify pricing with 30 days notice.

Data Ownership & Usage

Your Data: You retain ownership of all industrial data transmitted through AnywhereScada. We do not sell, share, or use your industrial data for purposes other than providing the service.

Our Rights: We may collect and analyze anonymized, aggregated usage statistics to improve the platform. This data cannot be used to identify you or your specific industrial processes.

Data Processing: By using AnywhereScada, you grant us the right to store, process, and transmit your data as necessary to provide the service.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. AnywhereScada is provided "as is" and "as available."

Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime, data loss, or service interruptions.

Acceptable Use Policy

You agree not to:

  • Use the service for illegal purposes
  • Transmit malware, viruses, or malicious code
  • Attempt to gain unauthorized access to other accounts or systems
  • Exceed reasonable usage patterns that degrade service for others
  • Resell or redistribute the service without authorization
  • Use the service to violate the rights of others

We reserve the right to suspend or terminate accounts that violate this policy.

Industrial Use Disclaimer

AnywhereScada is a data communication and storage platform. You acknowledge:

  • The service is not certified for safety-critical, life-safety, or emergency shutdown applications
  • Real-time performance is not guaranteed; network latency and service interruptions may occur
  • You are responsible for implementing appropriate safety systems independent of this platform
  • The service should not be the sole means of monitoring critical processes

Joy Automation, Inc. is not responsible for industrial accidents, equipment damage, or process failures resulting from service interruptions, data delays, or platform limitations.

API & Integration Terms

API access is provided subject to:

  • Rate limits as published in our documentation
  • Authentication requirements
  • Acceptable use policies

We may modify or deprecate APIs with reasonable notice. Excessive or abusive API usage may result in throttling or account suspension.

Intellectual Property

All platform code, designs, documentation, and branding are the intellectual property of Joy Automation, Inc. You may not copy, modify, or reverse-engineer the platform.

You retain ownership of your industrial data and any custom configurations you create.

Data Retention & Deletion

  • Active Accounts: Data is retained according to your space configuration
  • Account Deletion: Upon request, we will delete your account and associated data within 30 days
  • Billing Records: Retained as required for legal and accounting compliance

Termination

Either party may terminate at any time:

  • You may cancel your subscription and delete your account through the platform
  • We may suspend or terminate accounts for violations of these terms, non-payment, or at our discretion with notice

Upon termination, your access will be revoked and data may be deleted according to our retention policy.

Limitation of Liability

To the maximum extent permitted by law, Joy Automation, Inc.'s total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

Joy Automation, Inc. is not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, data loss, or business interruption
  • Third-party claims arising from your use of the service
  • Industrial accidents, equipment damage, or process failures

Indemnification

You agree to indemnify and hold harmless Joy Automation, Inc. from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Arbitration

Any disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the United States.

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Changes to Terms

We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
